This Consumer Health Data Privacy Policy applies to consumer health data as defined by the Washington My Health My Data Act and similar laws in Nevada and Connecticut. It adds to our Privacy Policy, which explains everything else we do.
1. The health data we collect
- Body information: weight, height, body fat percentage, age, and sex.
- Goals: your goal, and a target weight and timeframe if you set one.
- Food information: dietary restrictions, food preferences and dislikes, meals you log (text, and photos, which are discarded after use), and weight entries.
- Wearable and Apple Health data: recovery or readiness scores, Body Battery, heart rate variability, resting heart rate, respiratory rate, stress levels, sleep scores, stages and duration, strain, activity, energy burned, and workout summaries, as listed for each source in the Privacy Policy.
- Check-ins: how you tell us you feel.
- Information we derive: your daily and per-meal nutrition targets, a short description of your body's state (for example "recovering"), daily summaries, and which recommendations you accept or reject.
2. Why we collect it
Only to provide the Service you ask for: calculating your targets, recommending meals and recipes, showing your progress, estimating the nutrition of meals you log, and keeping the Service working and secure. We do not use it for advertising and we do not sell it.
3. Where it comes from
From you; from WHOOP, Oura, Google (for Fitbit), Garmin, and Apple Health when you authorize us; and from our own calculations on that information.
4. Who we share it with
- Our hosting and database provider, which stores it.
- Our AI processing provider, only with your permission: the items listed in Section 5 of the Privacy Policy. While Oura is your data source, nothing is sent.
- Our product analytics provider receives no health readings, scores, or body measurements. It receives, for example, which wearable you use, which kind of source a score came from, that you logged a meal or submitted a check-in, and counts about the recommendations you were shown, and you can turn it off in Settings under Account & security.
- No affiliates. We have none.
We do not sell consumer health data, and we do not set up geofences around places where people get health care.
5. Consent
We collect consumer health data with your consent, or where it is necessary to provide the Service you asked for. You give consent when you connect a wearable or Apple Health and when you allow the AI features. You can withdraw it by disconnecting the source, turning off the AI permission in Settings under Account & security, or deleting your account.
6. Your rights
You have the right to confirm whether we collect, share, or sell your consumer health data; to access it, including a list of the third parties we have shared it with and how to contact them; to withdraw consent; and to have it deleted, including by our service providers. We will not treat you differently for using these rights.
Email hello@othletic.com from the address on your account, or delete your account in Settings under Account & security. We answer within 45 days, extendable once by 45 days when reasonably necessary, and we will tell you if we extend. If we decline, you can appeal by replying with the word "appeal" within 45 days, and we answer within 45 days. If your appeal is denied, you can contact the Washington Attorney General at atg.wa.gov/file-complaint, or the Attorney General of your state.
7. Changes
We will tell you in the App before a material change to this policy, and ask for your consent again before we collect or share consumer health data for a new purpose.
